It's not uncommon in Arkansas for Agents to Represent Both the Buyer & the Seller in a Transaction. When this happens it is called Dual Agency.
A Dual Agency mostly occurs when a Real Estate Agent or two agents within the same Real Estate Firm, represent both Seller and Buyer in the same transaction.
For Dual Agency to occur the Buyer and the Seller must have given their written consent to dual representation prior to or at the same time of the execution of any Agency Agreement, Listing Agreement or Real Estate Contract. Both the Buyer and the Seller should be aware that a possible conflict of interest may exist in this type of representation. Dual Agency limits the duties that are found with Single Representation. For instance, when representing both Seller and Buyer the Dual Agent would not disclose to one party confidential information obtained from the other party.
